Technoacque Srl, headquartered at Via Maestri del Lavoro 1 Z.I. Sud – 72015 Fasano (Br) – VAT No. 03209900723, (hereinafter referred to as “Data Controller”), in its capacity as Data Controller, informs you pursuant to Article 13 of Legislative Decree 30.6.2003 No. 196 (hereinafter, “Privacy Code”) and Article 13 of EU Regulation No. 2016/679 (hereinafter, “GDPR”) that your data will be processed in the following ways and for the following purposes:

1. Object of Processing
The Data Controller processes personal data, including identifying information (e.g., name, surname, company name, address, telephone number, email, banking and payment references), hereinafter “personal data” or simply “data”, provided by you when concluding contracts for the services of the Data Controller.

2. Purpose of Processing
Your personal data are processed:
A) Without your express consent (Article 24, letters a), b), c) of the Privacy Code and Article 6, letters b), e) of the GDPR) for the following Service Purposes:

  • To conclude contracts for the services of the Data Controller;
  • To fulfill pre-contractual, contractual, and tax obligations arising from existing relationships with you;
  • To exercise the rights of the Data Controller, such as the right to defend itself in legal proceedings.

B) Only with your specific and distinct consent (Articles 23 and 130 of the Privacy Code and Article 7 of the GDPR), for the following Marketing Purposes:

  • To send you via email, post, SMS, and/or phone calls, newsletters, commercial communications, and/or advertising material on products or services offered by the Data Controller, and to conduct surveys on the quality of services;
  • To send you via email, post, SMS, and/or phone calls commercial and/or promotional communications from third parties (e.g., business partners).

Please note that if you are already our customer, we may send you communications related to services and products of the Data Controller similar to those you have already used and which are part of an existing contract.

3. Processing Methods
The processing of your personal data is carried out through the operations indicated in Article 4, No. 2 of the GDPR, namely: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, deletion, and destruction of data. Your personal data are subject to both paper and electronic and/or automated processing.

The Data Controller will process personal data for the time necessary to fulfill the above purposes and, in any case, for no longer than 20 years after the termination of the relationship, subject to legal provisions for the retention of tax data.

4. Access to Data
Your data may be made accessible for the purposes referred to in points 2.A and 2.B:

  • To employees and collaborators of the Data Controller in their capacity as internal processing officers and/or system administrators;
  • To third-party companies or other subjects (e.g., for shipping and packaging services, postal services, etc.) that perform outsourced activities on behalf of the Data Controller, in their capacity as external data processors.

5. Data Communication
Without the need for express consent (Article 6, letters b) and c) of the GDPR), the Data Controller may communicate your data for the purposes referred to in point 2.A to those entities to whom communication is mandatory by law for the performance of said purposes. These entities will process the data as independent data controllers.

Your data will not be disseminated.

6. Nature of Data Provision and Consequences of Refusal
Providing data for the purposes referred to in point 2.A is mandatory. Without it, we cannot guarantee you the services provided by the Data Controller.

Providing data for the purposes referred to in point 2.B is optional. You may decide not to provide any data or later deny the possibility of processing already provided data: in this case, you will not receive newsletters, commercial communications, and advertising material related to the services offered by the Data Controller. However, you will continue to be entitled to the services referred to in point 2.A.

7. Rights of the Data Subject
As a data subject, you have the rights referred to in Article 7 of the Privacy Code and Articles 11 and 12 of EU Regulation 2016/679, including the rights to:

  • Obtain confirmation of the existence of personal data concerning you;
  • Obtain details on the origin of personal data, processing purposes, and methods;
  • Request updates, rectifications, or, if interested, integration of the data;
  • Request the deletion, transformation into anonymous form, or blocking of unlawfully processed data;
  • Oppose, in whole or in part, for legitimate reasons, the processing of your personal data.

Where applicable, you also have the rights provided by Articles 16-21 of the GDPR, including the right to rectification, erasure, restriction of processing, data portability, and objection, as well as the right to lodge a complaint with a supervisory authority.

8. How to Exercise Your Rights
